NLRB Posting Requirement Suspended

In prior Dinse Briefs, we informed you about the National Labor Relations Board’s new rule requiring employers to post a notice of employee labor rights in the workplace.  This posting requirement was twice delayed, in part due to multiple legal challenges to the rule.  It has just been postponed indefinitely.   

Earlier this week, the D.C. Circuit Court of Appeals enjoined the Board from implementing its posting rule, which was to be effective April 30, 2012.   The injunction was requested by multiple parties who appealed a lower federal court’s decision upholding the NLRB’s authority to promulgate the rule.  Following issuance of the injunction, the NLRB announced that it will not implement the rule pending the resolution of the issues before the court.   

For now, employers are not required to display the NLRB posting in your workplace.  We will keep you informed of any further developments on this issue.
