Program Description:

Employers across the United States have been targeted by a tsunami of collective, class, and individual actions asserting a wide variety of claims under the Fair Labor Standards Act and state laws governing wage and hour issues.  Smart employers must ensure that their employees are properly classified and compensated in order to minimize the risk of costly lawsuits.  Once litigation is initiated, however, a variety of strategies can be used to help achieve beneficial outcomes and/or at least limit exposure.  Leading labor and employment lawyersfrom across the country willshare their expertise and experiences in how to prevent these disputes and effectively defend these lawsuits, with a particular focus on:

  • Wage and hour audits and reclassification exercises – processes and pitfalls
  • Litigating wage and hour disputes – collective actions, class actions, and individual claims
  • Special off-the-clock issues
  • New developments in the enforceability of arbitration agreements with respect to wage and hour claims
  • Resolving wage and hour disputes in the most cost effective manner possible
  • Complying with the wage and hour laws of multiple jurisdictions – special considerations for national employers
