New Jersey Passes Wage Transparency Law

On September 26, 2024, the New Jersey Legislature passed Senate Bill 2310. This new law requires New Jersey employers to include certain information about compensation and benefits in both internal and external job postings.  Governor Murphy has 45 days (i.e., until November 10, 2024) to sign the bill into law, and, once signed, it will go into effect seven months later.

With this new law, New Jersey joins a growing number of states, including New York, California, and Illinois, that require employers to disclose salaries or salary ranges in job postings.

In particular, New Jersey’s law requires employers to include in each internal and external job posting either the exact wage or salary for the position or a pay range.  Employers must also include a general description of the benefits or other compensation programs for which an employee who is hired into that position would be eligible within 12 months of starting employment.  

The law would also require employers to “make reasonable efforts” to inform current employees about promotion opportunities within the company.  This applies to any job posted internally or externally, but it excludes any promotions that are awarded solely based on years of experience or promotions given due to unforeseen events. 

Violations of any of the above new requirements would result in an initial fine of $300, and $600 for any subsequent violations.

New Jersey’s law applies to employers with 10 or more employees, without regard to any such employee’s residence, so long as the employer either does business, employs persons or takes applications in New Jersey.  Employers that meet this criterion should review their current job posting and compensation ranges and be prepared to include these requirements in future job postings if/when the law goes into effect.
