This chapter explores the significant rise in the use of international arbitration to resolve disputes in the Philippines, aligning with the nation's public policy that favors arbitration and emphasizes the inclusion of arbitration clauses in commercial contracts.

While disputes between domestic parties remain predominantly resolved through court litigation, there is a noticeable shift towards international arbitration for matters involving foreign counterparts or transactions with an international element. This preference is driven by the advantages of expedited resolutions, greater predictability, and reduced court intervention. The increasing inclination towards international arbitration reflects its effectiveness not only as a mode of dispute resolution involving foreign entities but also for the enforcement of foreign arbitral awards.
