MBJ previously issued an alert entitled “Massachusetts Department of Family and Medical Leave Publishes 2023 Workplace Poster, Workforce Notifications, and Rate Sheets”, which outlined employer requirements with respect to posting the 2023 Paid Family and Medical Leave (“PFML”) workplace poster, issuing 2023 Notices to new employees, and providing 2023 rate sheets to current employees. This alert can be found here. We are supplementing this alert to clarify that 2023 rate sheets must be provided to current employees 30 days before the effective date, i.e., by December 2, 2022. The rate sheets may be provided electronically and do not require employees’ signed acknowledgment. Employers should contact their MBJ attorney for any questions regarding the 2023 rate sheets, workplace posters, or notices. MBJ will continue to monitor developments from the Department.
