Resolution No. 142/2021 of the Ministry of Labor, Employment and Social Security (the “Resolution”) was published today in the Official Gazette, affecting how enforcement provisions in Remote Employment Law No. 27,555 are to be interpreted.

Pursuant to the Resolution, while sanitary restrictions and recommendations are in place, the consent required under Section 7 of Remote Employment Law No. 27,555 stands even if employees cannot attend their work place and perform their tasks from home pursuant to Presidential Decree No. 260/2020 and Resolution No. 207 of the Ministry of Labor, and their amendments, or if preventive measures are implemented by the employer to minimize risks of infection.

The Resolution is in force as of March 19, 2021.
