On April 13, 2021, the Occupational Safety and Health Administration (OSHA) cited Liberty Tax Service of Lynn, Massachusetts for prohibiting its employees and customers from wearing masks, failing to ensure employees and customers practiced social distancing and refusing to implement other safeguards against the coronavirus. The Massachusetts-based business now faces $136,532 in penalties.

This enforcement action is pursuant to an OSHA “National Emphasis Program- Coronavirus Disease 2019” launched on March 12, 2021 which focuses its enforcements efforts on companies that put the largest number of workers at serious risk of contracting the coronavirus. The program also prioritizes employers that retaliate against workers for complaints about unsafe or unhealthy conditions, or for exercising other rights protected by federal law.

Employers should be careful when relaxing mask and social distancing policies.
