In September 2021, AA Gestors successfully defended the interests of an individual when considering a lawsuit against JSC “Ukrzaliznytsia” for recovery of wages, recovery of average earnings during delay in dismissal, recognition of discrimination and obligation to eliminate its manifestations.
The Client addressed the court due to the non-payment of wages in the form of bonuses and rewards for the period from 2017 to 2020 by the JSC “Ukrzaliznytsia” in connection with the illegal inaction of the company, which consisted in long-term evasion of the employer's obligations under current legislation of Ukraine, the Company’s Charter and employment agreement.
The case was considered by the Podilskiy District Court of Kyiv within a year. By its decision dated 14.09.2021, the court partially satisfied the claim of our Client, and decided to recover from JSC “Ukrzaliznytsia” in his favor additional wages and incentive payments for the period from 01.01.2017 to 31.12.2019 in the amount of UAH 27 782 429, 98, average earnings during the delay in payment upon dismissal in the amount of UAH 2 790 109, 24.
By an Additional decision dated 07.10.2021, Podilskiy District Court of Kyiv resolved to turn to immediate execution the decision dated 14.09.2021 in its part related to collection of wage arrears within one month payment in the amount of UAH 449,795.
