2017 Outlook: Immigration Compliance Under the New Administration

The new year could be especially impactful for employers who may see increased worksite enforcement related to their compliance with the Form I-9 requirements and E-Verify, as well as on-site audits when petitioning for H and L status.

Last year higher civil penalties went into effect related to employers’ non-compliance with the Form I-9 requirements. This month, employers must begin to use the new and enhanced version of the Form I-9 issued by U.S. Citizenship and Immigration Services (“USCIS”). We expect worksite enforcement actions, which have been steadily increasing over the years, to continue during the Trump Administration and likely be more robust. Fees are expected to increase to fund expansion of employer audits.
