Jaclyn L. Kugell is the Chair of Morgan, Brown & Joy's Management Committee. Since 1992, Jackie has represented employers in the Massachusetts Courts, United States Federal District Courts including Georgia, Kentucky, Massachusetts, New Hampshire, New Jersey, Ohio and Rhode Island, and the United States Court of Appeals for the First and Eleventh Circuits, in employment litigation matters.
Jackie has also represented employers at State and Federal agencies including among others, the Equal Employment Opportunity Commission, the Massachusetts Commission Against Discrimination ("MCAD"), the Rhode Island Human Rights Commission, the New Hampshire Human Rights Commission, the Vermont Attorney General's Office, the Massachusetts Labor Relations Commission, the National Labor Relations Board, and the Civil Service Commission. She also represents employers at arbitration hearings and negotiates collective bargaining agreements.
Jackie regularly conducts seminars and training programs on unlawful harassment, preventing discrimination and fostering diversity, effectuating reasonable accommodations, effective and defensible disciplinary tools, supervisory skills, progressive discipline, lawful hiring practices, the Family and Medical Leave Act ("FMLA"), the interrelationship of the FMLA, disability discrimination laws, and workers' compensation statutes and integrated leave and attendance programs. She also advises employers on the variety of labor and employment law issues.
Jackie has been a featured speaker for, among other organizations, the Massachusetts Continuing Legal Education ("MCLE"), 1999-2014, including serving as Co-Chair for the MCLE Employment Law Conference, 2007-2013; the Defense Research Institute, 2007-2008; the Massachusetts Bar Association, 1995-1996, 2007; the Boston Bar Association, 2002, 2009; Associated Industries of Massachusetts, 1994-2004; Lorman Education Services, 1994-2004; The Employers' Association of Western Massachusetts, 1999; New England Corporate Counsel Association, 1996, 2003.
Jackie has completed the MCAD's Certified Train-the-Trainer Courses. She has been the faculty Co-Chair for the MCAD's Certified Harassment Train-the-Trainer Program, 2001-2014; a faculty member for the MCAD's Certified Discrimination Train-the-Trainer Program, 2003-2013; and a faculty member for the MCAD's Certified Investigations Course, 2006-2014, and Certified Accommodations Course, 2009-2014.
