GUIDELINES FOR CONTENT RATING FOR BROADCASTING
AND PAY TV AND AUDIO SERVICES
On November 4, 2015, the Ministry of Interior (Secretaría de Gobernación) published in the Official Gazette of the Federation (“DOF” for its acronym in Spanish) the Guidelines for Content Rating for broadcasting and pay TV and audio services (Lineamientos de Clasificación de Contenidos Audiovisuales para servicios de radiodifusión y televisión y audios restringidos) (the "Content Rating Guidelines”). The Content Rating Guidelines will enter into force 30 business days after their publication in the DOF, that is on December 16, 2015.
The Content Rating Guidelines establish rules regarding content rating classifications which will need to be taken into account by concessionaires of broadcasting and pay TV, audio services and by programmers (the “Service Providers”).
The Content Rating Guidelines establish the following rating categories, which are subject to the characteristics and requirements provided therein: (i) "AA" Content for children; (ii) "A" Content for all age groups; (iii) "B" Content for teens and adults; (iv) "B15" Content for teens over 15 and adults; (v) "C" Adult content; and (vi) "D" Exclusive content for adults.
Likewise, the Content Rating Guidelines establish in their Sanctions section, the procedure to sanction non-compliance with the content rating classification.
