Dr. Jan Tibor Lelley from the German law firm, Buse Heberer Fromm, has joined California labor and employment law boutique Hirschfeld Kraemer LLP as its European Union data privacy counsel – a newly created position made possible through the firm’s membership in the international legal network the Employment Law Alliance (ELA).

Lelley is the second ELA attorney to join HK. In 2014, the firm added Leigh Cole of Vermont-based Dinse Knapp & McAndrew, P.C as immigration counsel. Lelley, like Cole, maintains his position at his parent firm, but is available as a resource for HK clients wrestling with E.U. data privacy concerns.

“Bringing on Jan is a natural extension of the ELA’s mission and Hirschfeld Kraemer’s role as a charter member firm,” said Stephen J. Hirschfeld, co-managing partner of Hirschfeld Kraemer and ELA’s founder. “Jan’s skillset and perspective is unique and provides our multinational clients with an ‘on-the-ground’ E.U. resource that goes well beyond simply having a U.S.-based attorney who keeps tabs on developments. This is crucial as data privacy in Europe is a paramount concern for employers and regulations are wildly different from what we have here in the U.S.”

Lelley is a partner at Buse Heberer Fromm, where he works exclusively on labor and employment law cases. He holds an LL.M. in international business law from Suffolk University Law School and is admitted to the bar as a certified specialist for labor and employment law (Fachanwalt für Arbeitsrecht).

Lelley counsels Hirschfeld Kraemer clients on a wide range of E.U. data privacy issues, including proper maintenance, utilization and access to human resources and personnel data when transferring information outside of the E.U. and conducting cross border discovery; conducting employee monitoring and use/abuse of social media by employees; implementing appropriate data privacy rules and data protection compliance programs; and conducting data privacy audits.

“This is an exciting opportunity to expand my practice, leveraging the ELA’s impressive geographic reach,” said Lelley. “In a data-driven world, with information frequently crossing borders, it is crucial that companies stay abreast of the varied rules and regulations that govern this traffic. This partnership furthers the central goal of the ELA – helping employers conduct business seamlessly and lawfully worldwide.”
