The Department of Labor's proposal to modify the Fair Labor Standards Act (FLSA) is expected to be released this month, and the potential updates have raised concern for employers. Crowe & Dunlevy Labor & Employment attorney Leonard Court testified at the Education and Workforce Committee's Subcommittee on Workforce Protections hearing on Wednesday, June 10. The hearing was held in response to President Obama's request to "modernize and streamline" portions of the FLSAi.




During his testimony, Court highlighted the challenges imposed by Department of Labor investigators, including aggressive enforcement tactics, combative questioning and coercion. He also addressed areas of the FLSA that should be revised to reflect contemporary workplaces, while responding to proposals that could negatively impact employers.
